Welcome to SoundForge Studios. Please read these terms and conditions carefully before using our services.

Agreement to Terms

By accessing or using the services provided by SoundForge Studios, located at 14 Wellington Avenue, Clifton, Bristol, BS8 2AG, United Kingdom, and operated by Amelia Stone, you agree to be bound by these Terms and Conditions ("Terms"). These Terms apply to all visitors, users, and others who access or use the Service. If you disagree with any part of the terms, then you may not access the Service.

SoundForge Studios reserves the right to modify or revise these Terms at any time. It is your responsibility to review these Terms periodically for changes. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

If you are using our services on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these terms. In that case, "you" and "your" will refer to that organization.

Use of Services

SoundForge Studios offers a range of audio production services, including:

  • Recording
  • Mixing
  • Mastering
  • Sound Design
  • Voiceover Recording
  • Audio Restoration
  • Podcast Production
  • ADR (Automated Dialogue Replacement)

These services are provided subject to the following conditions:

  1. Service Agreements: All services provided by SoundForge Studios are subject to a separate service agreement outlining the specific details of the project, including timelines, deliverables, and payment terms. This service agreement must be signed and agreed upon by both SoundForge Studios and the client before any work commences.
  2. Payment: Payment for services is due as outlined in the service agreement. SoundForge Studios accepts payments via bank transfer, credit card, and PayPal. Late payments may be subject to interest charges. A deposit may be required to secure booking of studio time.
  3. Cancellation Policy: Cancellations must be made at least 48 hours in advance of the scheduled service. Cancellations made within 48 hours may be subject to a cancellation fee, as determined by the specific service agreement.
  4. Client Responsibilities: Clients are responsible for providing all necessary materials, information, and approvals required for the completion of the project. Failure to do so may result in delays and additional charges. Clients are expected to conduct themselves professionally and respectfully while using the studio facilities.
  5. Studio Usage: Clients using the studio facilities are responsible for any damage caused to equipment or property. SoundForge Studios reserves the right to charge clients for any repairs or replacements required due to misuse or negligence. Eating and drinking are permitted only in designated areas.
  6. Third-Party Content: If you use our services to process content that belongs to someone else (e.g., for mixing or mastering), you must ensure that you have the necessary rights and permissions to do so. SoundForge Studios is not responsible for verifying the legality of third-party content provided by clients.

Intellectual Property

SoundForge Studios retains all intellectual property rights in and to the services it provides, including but not limited to, all software, technology, processes, materials, guidelines, documentation, and trademarks. Clients retain ownership of their original audio recordings and compositions.

Regarding the finished product:

  • Ownership: Clients own the copyright to the finished product they create using SoundForge Studios' services, subject to any pre-existing rights of third parties. SoundForge Studios retains the right to use excerpts of finished projects for promotional purposes, unless otherwise agreed upon in writing.
  • Licensing: SoundForge Studios may license its technology and processes to third parties, but such licensing will not affect your ownership rights in your finished product.
  • Moral Rights: To the extent permitted by applicable law, you waive any moral rights you may have in the finished product.

Clients are responsible for securing all necessary licenses and permissions for any copyrighted material used in their projects. SoundForge Studios is not responsible for any copyright infringements committed by clients.

SoundForge Studios will not use any recorded material for any commercial purposes without expressed written permission from the client. All unreleased material is treated with the utmost confidence and securely backed up on multiple systems to ensure the safety of your work.

Limitation of Liability

To the maximum extent permitted by applicable law, SoundForge Studios shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Service; (d) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our Service by any third party; (e) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the service; and/or (f) the defamatory, offensive, or illegal conduct of any third party. In no event shall SoundForge Studios' aggregate liability for all claims relating to the service exceed the amount you paid SoundForge Studios, if any, during the six (6) months prior to the act giving rise to the liability.

SoundForge Studios is not liable for any loss or damage to client-provided materials, although we take every precaution to ensure their safety. Clients are encouraged to maintain backup copies of all original materials.

SoundForge Studios will not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Bristol, United Kingdom.
